| Making A Purchase Terms and Conditions of Sale Interpretation In these terms and conditions: "Imagination Technologies", "Pure Upgrade Centre" or "Service" means the on-line service provided by us through www.puredigital.com from time to time. "Person" means an individual, or a body corporate or unincorporated, and "Persons" shall be construed accordingly. "You" or "Your" means the Person using this site or named in the registration details (if any) accompanying these terms and conditions. "Your Communications" means any communications received or sent by You through the Service including e-mails and other electronic messages. "Your Material" means any material within the Service which originated from You through the Service. "We" and "Us" and "The Company" means "Imagination Technologies Ltd" and or "PURE Service Centre". Imagination Technologies and Pure Upgrade Centre Your initial order has been placed on the website for Imagination Technologies Ltd and its division PURE Digital, however, in the interests of improving the service received by you we are using our 3rd party fulfillment company to process and deliver all web-shop orders placed through www.puredigital.com Whilst this will improve and increase service levels you should note that all payments (and when appropriate, credits) are being processed by PURE Service Centre and not Imagination Technologies Ltd. It will therefore appear on your card issuer's statement as PDUC (Pure Digital Upgrade Centre). In order for this to be carried out you will be transferred from www.puredigital.com to the PURE Upgrade Centre website and onto their secure servers to process all delivery and payment information. Any queries on this secure site should be directed to sales@pureservicecentre.co.uk or the webshop helpline at 01273 497764. Introduction Please read the terms and conditions set out below. When You access this site for the first time You agree to be bound by all terms and conditions for the use of this Service. We may vary the terms and conditions for the use of this Service from time to time by posting revised terms and conditions on the site. It is Your responsibility to check whether the terms and conditions have been revised. Your use of this service after the date on which we post the revised terms and conditions shall be deemed to constitute Your acceptance of the revised terms and conditions. If You do not agree to be bound by these terms and conditions You must stop using this site immediately. Our Contract You will have an opportunity to check and correct any input errors in your order up until you submit your order (by clicking the Submit Order button on the Submit Order page). After submitting an order to us we will give you an Order Reference Number and details of the products you have ordered. We will send these details to you in an e-mail. Please note that this e-mail is an acknowledgement, not acceptance of your order. We may decline all or part of your order for any reason, in which case We will contact you to confirm our actions. When deciding whether or not to accept your order we may use certain information about you, including any credit checks on your payment method as appropriate. This helps to protect you and us against fraudulent transactions. We will tell you if your payment details cannot be authorised for any reason and may invite you to pay by another method. Data regarding your card and related card-holder address details will be passed between Us for the purposes of checking for fraudulent transactions. Prices and Payment All prices and charges on this site are shown in UK pounds sterling. They include any VAT payable (if you are ordering from a country where VAT is not applicable then this will be amended on the order confirmation page), but exclude delivery charges (delivery charges will be shown on your order confirmation page). The total cost of your order will be the price of the products you order plus the applicable delivery charge. All these will be set out clearly in your Shopping Basket before you submit your order. We try very hard to ensure that all information on this site is accurate. However, just occasionally, an error can occur. If we discover an error in the price or description of a product you have ordered, we will tell you and ask you whether you wish to continue with your order or cancel it. We accept payment by Mastercard, Visa, Delta, Switch. Payment is deducted when we process your order. If your card account is in a currency other than UK pounds sterling then your final charge will depend on the current rate of exchange and any other appropriate charges levied by your card issuer. These are out of the control of Imagination Technologies Ltd and The PURE Upgrade Centre. Your card details will be held by PURE Service Centre for 35 days. This is to cover the processing of any orders which are awaiting stock, or so that credits can be processed easily should this be a required action. Delivery All deliveries must be signed for (except items sent by post and which are small enough to be put through your letterbox). Please make sure you keep the receipt enclosed with your goods. Smaller products of low value are generally delivered by post. Larger products and those with a higher value are generally delivered by courier (either CityLink or UPS (for overseas orders)). Very occasionally different products in the same order may be delivered separately. Delivery by post will normally take 2-5 working days. However we must allow 10 working days before we consider the order as lost. Delivery times for courier shipments will be Monday to Friday, 9am to 5.30pm. In the interests of keeping your delivery costs to a minimum we are unable to offer more precise time-frames than this. We will, however, deliver to your workplace or other nominated address in the interests of easing this process. Missing, Damaged or Incorrect Orders We try very hard to ensure that you receive your order in pristine condition. If you do not receive all your products, please check that they have been despatched by contacting our webshop helpdesk at 01273 495042 or sales@pureservicecentre.co.uk . In the unlikely event that a product arrives damaged or faulty, you should also contact this number and they will explain what steps should be taken. These steps are also described further down in these Terms and Conditions. Backorders We endeavour to keep product stocked to a level where we are able to ship on receipt of order. Stock levels will be indicated to you while you are placing your order. However, we may have to leave your requirements on backorder should we have sold through on stock lines or in the unlikely case of a stock discrepancy. If this is the case then the whole order will be held back until the appropriate product is in stock in our warehouse. We anticipate delays of no more than 28 days. Should this be exceeded then you will be contacted to see what action you wish to take - i.e. whether to cancel, amend or continue with your order. We shall keep your credit/debit card details on record for 45 days for the purposes of being able to fulfill your order without re-contacting you when stock is delivered. Order Cancellations You can cancel your purchase at any time either before or up to 14 days after delivery: Before delivery: Please contact the help desk at 01273 497764 or sales@pureservicecentre.co.uk. You will need to have your order reference to hand in order to help on this matter. The helpdesk staff (or an e-mail response) will confirm cancellation. After delivery: Please contact the help desk at 01273 497764 or sales@pureservicecentre.co.uk to notify us of your wish to cancel. We must have an official request to cancel in writing, either by fax, e-mail or letter. You must include the order reference, order details and what you wish to return. Following receipt of your request to cancel, you will be given a reference number to include on your return paperwork and an address to return the product to. Return of the product is at your cost,. When the product is received (and reliant on passing inspection) then you will receive credit in full to the value of your original order (including our outbound shipping charges but not your return shipping costs). *Return requirements: Your product must be complete and in 'as new' condition (e.g. if you have opened the box to examine the product you must have done so without damaging or marking the product in any way). It should be returned with the original box, packing and accessories. Pre-recorded videotapes, DVDs, CDs, minidiscs and other software must be sealed. Any 'Free Gifts' received with the product must also be returned. Where these requirements have not been met then the total you will be credited may be affected. You will be contacted should this be the case. Return of Goods Product faulty within 14 days of delivery: Should you wish to return your product for repair or replacement then please contact our Technical Support line on 01923 277477 Should you wish to return your product for credit, then please contact the help desk at 01273 497764 or, to notify us of your faulty product. You must have your order reference to hand. Please note the return requirements above, failure to follow this may affect how much you are credited. Product faulty after 14 days from delivery (but within product warranty period): Should you wish to return your product for repair or replacement then please contact our Technical Support line on 01923 277477 Should you wish to return a faulty product after 14 days from delivery you are entitled to a refund within 28 days. After this period (but within the warranty period) we must be given fair chance to repair or replace the faulty product. Please note the return requirements above, failure to follow this may affect how much you are credited. Incorrect Product received: Should you receive incorrect products from that which you had confirmed as being ordered then please contact the help desk at 01273 497764 or sales@pureservicecentre.co.uk, to notify us of this. We will arrange the collection of the mis-shipped products and ensure that the correct order and product is sent out to you as soon as possible. If the item is small then you can return via Royal Mail and we will refund the postal charge. Order confirmed as shipped but not received: Should you have shipment of your order confirmed but not receive a delivery then please contact the help desk at 01273 497764 or sales@pureservicecentre.co.uk, to notify us of this. We will investigate the shipment, track it where possible, and on completion of this investigation either provide appropriate proof of delivery or ship out a replacement order. This guidelines do not cover faults caused by accident, neglect, misuse or normal wear and tear. THIS RETURNS POLICY DOES NOT AFFECT YOUR LEGAL RIGHTS Liability In performing any obligation under this terms and conditions of use policy, our duty is only to exercise reasonable care and skill of a competent on-line Service provider. We shall not be liable for any damages, including without limitation, indirect or consequential damages, howsoever arising out of your use of this site or in respect of any of your actions or omissions taken in reliance on any of the advice or information contained on this site or any site to which this site is linked. We are not liable for any failure to perform any of our obligations under these terms and conditions caused by matters beyond our reasonable control. Third party sites Any hypertext links this site contains to sites that are not operated by us or by our associated companies are not controlled by us and as such we are not responsible for their content. Matters beyond our reasonable control If We are unable to provide this Service because of something beyond our reasonable control such as technical failure, lightning, flood, or exceptionally severe weather, fire or explosion, civil disorder, war, or military operations, natural or local emergency, anything done by government or other competent authority or industrial disputes of any kind (whether or not involving our employees), We will not be liable for this. Jurisdiction These terms and conditions and all transactions relating to this website are governed by English law and are subject to the non-exclusive jurisdiction of the English courts. We do not accept amendments to these terms and conditions. Additional terms and conditions may apply for prize competitions, pre-release orders and our added value services and offers. If so, you will be alerted to them at the relevant juncture.
